This is legal FACT,as discovered today 4/11/15, which no one else has yet been willing to share.
ESA appeal, during transition, forced onto JSA...
LOOPHOLE is: If you have not advised DWP of 1 of your many conditions or your conditions have become worse or aggravated you can reapply for ESA.
Although a brand new claim for ESA, whilstawaiting Appeal, they will be joined together after Tribunal. Making the new claim,instantly removes the need to claim JSA. FACT!!!!!. This protects vulnerable not fit for work but please remember up to date sick note from GP essential as always.
Proviso is, to be successful, you must provide new letters from ADSAC,GP's Consultants etc, evidencing that you have become worse.
Why we are reporting this to you,have just currently used this path with a recent case.
